Terms of Service

Welcome to Promity, an AI-powered platform developed by Mobile-Brain Ltd. We've designed our terms to be as clear as our "Prompt-to-App" tool, Promity.
1. Terms of Use
By accessing or using Promity, you represent and warrant that you are at least 13 years of age and have the legal capacity to enter into this binding agreement. If you are under 13, you are prohibited from using this service. If you are between 13 and 18 (or the age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these terms on your behalf.
- The Service: Promity allows you to create app prototypes using simple AI prompts. We are currently in Beta. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE MAKE NO GUARANTEE REGARDING SUITABILITY, RESULTS, ACCURACY, RELIABILITY, OR AVAILABILITY OF THE SERVICE.
- Your Content: You retain all ownership rights in the ideas and apps you generate through Promity. However, by using the tool, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display your prompts and generated content for the purposes of: (a) providing and operating the Service; (b) improving our AI models using anonymized data; and (c) integrating components into our software and services. You represent and warrant that you have all necessary rights to grant this license and that your content does not infringe any third-party rights.
- Prohibited Content: You agree not to use Promity to generate, transmit, or store content that: (a) promotes, facilitates, or encourages illegal acts under applicable law; (b) constitutes hate speech, harassment, threats, or violence; (c) is obscene, defamatory, or invasive of privacy rights; (d) infringes on any third party's intellectual property, proprietary, or privacy rights; (e) contains malware, viruses, or harmful code; (f) impersonates any person or entity; or (g) violates any applicable laws or regulations. We reserve the right to remove any prohibited content and suspend or terminate accounts that violate this provision, with or without notice.
- Monetization: We reserve the right to introduce premium features, subscription plans, and revenue and payment models at our sole discretion. Fees paid are non-refundable except as required by law or as expressly stated in the applicable payment terms.
2. Privacy
We respect your privacy. This section explains what we collect and why. We make every effort to comply with applicable laws, including the EU General Data Protection Regulation (GDPR) and the Israeli Privacy Protection Law (2024/25 Amendments).
What We Collect
- Account Data: When you log in via Google, we receive your Name, Email Address, and Profile Picture. This is used solely to manage your account and save your projects.
- Prompt Data: We store the prompts you enter to provide the Service and improve our AI models. We anonymize these logs by removing direct identifiers before using them for technical improvements and model training. However, you should be aware that prompts may contain information you choose to include, and you should not include sensitive personal information, trade secrets, or confidential information in your prompts. While we implement anonymization procedures, we cannot guarantee that re-identification is impossible in all circumstances.
- Technical Data: We collect basic device information (IP address, OS type) for security and performance monitoring.
How We Use Your Data
- To provide and maintain the service.
- To improve our AI algorithms (using anonymized data).
- To communicate important updates regarding your account.
Data Retention & Security
- Retention: Anonymized prompt logs are kept for 12 months for model training. Account data is kept as long as your account is active.
- Storage: Data is stored on secure cloud servers that meet international security standards.
- Sharing: We do not sell your data. We only share data with essential service providers (such as Google for login) or when required by law.
3. Cookie & Tracking Policy
Promity may use cookies to the extent permitted by law, to function correctly:
- Authentication: Essential cookies to keep you logged in via Google.
- Performance: Basic analytics to see how many people are building apps.
- Control: You can manage or disable cookies in your browser settings, though this may impact app functionality.
4. Your Rights
Whether you are in Israel, the EU, or elsewhere, you have the right to:
- Access & Export: See what data we have about you.
- Delete: Request that we delete your account and personal data.
- Correct: Fix any inaccurate information.
- To exercise any of these rights or for any privacy-related questions, email our Data Protection and Compliance team at dpo@mobile-brain.com. We will respond to your request within thirty (30) days of receipt. If we need additional time, we will notify you of the reason and extension period. You also have the right to lodge a complaint with a supervisory authority if you believe your privacy rights have been violated.
5. Accessibility
We believe technology should be for everyone. Promity is implementing a Handicap Assist Plugin to ensure our platform is accessible to users with disabilities, in accordance with applicable regulations.
6. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively to the competent courts of law in Tel Aviv, and you irrevocably consent to the personal jurisdiction and venue of such courts. YOU AND MOBILE-BRAIN LTD AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. Notwithstanding the foregoing, we may seek injunctive or other equitable relief in any court of competent jurisdiction to protect our intellectual property rights.
